Terms of use

This English version is provided for your convenience. The French version of these terms is the authoritative one.

These terms govern the use of UNQ’s websites and of its service: the brand space, the advisor installed on a brand’s website, and the tools that connect to them. The commercial terms, for their part, are set out in the contract signed with each brand.

1. Purpose and scope

These general terms of use (the “Terms”) set out the conditions under which any person (the “User”) accesses and uses the Sites and the Service of UNQ, société par actions simplifiée (SAS), a French simplified joint-stock company whose details appear in the legal notice.

UNQ does not publish any price list, and there are therefore no general terms of sale. The price, duration, service level and other commercial terms are set out in the contract entered into between UNQ and each Brand (the “Contract”). In the event of a conflict between the Contract and these Terms, the Contract prevails.

By browsing the Sites or using the Service, the User accepts these Terms.

2. Definitions

  • Sites: unq.pro, which presents UNQ’s offering to brands, and unq.you, the page of UNQ’s marketplace.
  • Service: the UNQ platform, which includes the brand space, the UNQ team’s back office, the Advisor and the programming interfaces used to connect to it (API, command-line tool, MCP server).
  • Brand: the client company that has signed a Contract with UNQ.
  • Member: a person, employee or contractor of a Brand, who has an account on the brand space.
  • Advisor: the conversational advisor, powered by artificial intelligence, that a Brand installs on its own website.
  • Visitor: a person who talks with the Advisor on a Brand’s website.

3. Access to the Sites and the Service

The Sites are accessible free of charge and without registration. Connection and equipment costs are borne by the User.

The brand space is reserved for Brand Members, who access it by invitation, and for the UNQ team. Each Member is given one or more roles there that determine what they can see and do for their Brand: editing the Brand’s file, approving it, configuring the integration, viewing billing, for example.

The Advisor is accessible to Visitors on the website of the Brand that installed it, under the conditions that this Brand sets for its own website. At the Visitor’s request, it may offer to log in (a code received by email, a Google account or a key saved on their device) to find their conversations again.

4. Accounts and security

An account is strictly personal. The User undertakes to provide accurate information, to keep their login methods (password, two-factor authentication code, keys saved on their devices) confidential and not to share them.

The User is responsible for the actions carried out from their account. If they notice or suspect unauthorised use, they inform UNQ without delay at contact@unq.you, and can remotely close all their sessions from the brand space.

The Brand designates the people it invites and the roles it gives them, and removes the access of a Member who leaves it. UNQ recommends enabling two-factor authentication.

5. User obligations

The User undertakes to use the Sites and the Service fairly, and in particular not to:

  • undermine their security or operation, or attempt to access data or areas not intended for them;
  • extract their content in an automated or large-scale manner, outside the programming interfaces provided for that purpose;
  • decompile, copy or reproduce the Service, or use it to design a competing service;
  • divert the Advisor from its purpose, for example by trying to make it produce unlawful, misleading or off-topic content unrelated to the Brand;
  • upload or enter content that is unlawful or infringes the rights of a third party.

6. Intellectual property

The Sites, the Service and each of their elements (software, texts, illustrations, photographs, videos, layouts, the UNQ name and logo) are protected by intellectual property law. They belong to UNQ or are used with the permission of their owners.

The Contract gives the Brand and its Members a right to use the Service for the Brand’s purposes, for its duration. No other assignment or licence is granted. Any reproduction or use of the Sites or the Service without UNQ’s prior written permission is prohibited, subject to the exceptions provided by law, in particular short quotations citing their source.

The “Maison Oriel” brand, its products, advisors and customers, as well as the conversations, journeys and figures that accompany them on unq.pro, are illustrations designed to present how UNQ works. They do not refer to a client brand.

Third-party trademarks and logos cited on the Sites remain the property of their respective owners.

7. The Brand’s content and data

The Brand remains the owner of the content it entrusts to UNQ or that UNQ collects at its request: product catalogue, brand file, uploaded documents, profiles and photos of its advisors. It authorises UNQ to host, process and reproduce this content solely to the extent necessary to provide the Service, for the duration of the Contract.

When the Brand asks UNQ to read its catalogue, UNQ browses its public pages and downloads the images, in order to then serve them from its own servers. The Brand warrants that it holds the necessary rights to this content.

For the Advisor’s conversations, the Brand is the controller of its Visitors’ data, and UNQ acts as its processor, under the conditions of the Contract. The privacy policy describes this.

8. Artificial intelligence and the limits of its answers

The Advisor is an artificial intelligence, and it presents itself as such: every conversation carries the mention « Conseil par IA » (“AI advice”). No human advisor replies in a conversation; a human advisor from the Brand may, however, meet the Visitor at an appointment that the Advisor offers them.

The Advisor’s answers are generated automatically, from the Brand’s catalogue and content. Despite the care taken, they may be incomplete, inaccurate or out of date, in particular as regards a price, availability, a dimension or a delivery time. They constitute neither an offer nor a commitment: only the information published by the Brand on its product pages and in its terms of sale is authoritative.

The Visitor is invited to check any decisive information before buying, and not to share sensitive information with the Advisor (health, bank details, opinions, for example), which it does not need.

Likewise, in the brand space, the drafting suggestions for the brand file are produced by an artificial intelligence: the Brand reviews them and remains the sole judge of what it approves.

9. Availability

UNQ strives to keep the Sites and the Service accessible, without being bound by an obligation of result. Access may be suspended, in particular for maintenance or update operations. Any service level commitments are those of the Contract.

10. Liability

The information published on the Sites is provided for general and indicative purposes. The examples, journeys, screenshots and figures presented illustrate how UNQ works and have no contractual value.

Towards a Brand, UNQ’s liability is that set by the Contract. Otherwise, UNQ cannot be held liable for:

  • an interruption or unavailability of the Sites or the Service;
  • damage resulting from a fraudulent intrusion by a third party or from malicious software, despite the security measures in place;
  • a decision taken solely on the strength of an answer from the Advisor, without checking;
  • content supplied by a Brand, or third-party websites to which the Sites link;
  • use of the Sites or the Service that does not comply with these Terms.

Nothing in these Terms excludes a liability that cannot be excluded by law.

11. Hyperlinks

The Sites contain links to third-party websites, for example LinkedIn profiles. UNQ has no control over these websites and is not responsible for their content.

Linking to the home page of a Site is free, provided that the link does not harm UNQ’s image and does not suggest a partnership that does not exist. Displaying the pages of a Site within another website requires UNQ’s prior consent.

12. Demo request form

unq.pro offers a form that allows a brand to request a demonstration. The User undertakes to provide accurate information in it. Sending it creates no contractual commitment, either for the User or for UNQ, which remains free not to follow it up. To prevent abuse, the number of submissions from the same IP address is limited.

13. Suspension and termination

UNQ may suspend the access of a User who breaches these Terms or endangers the security of the Service, informing the Brand concerned when the User is a Member.

A Member’s access ends when the Brand removes it, or at the end of the Contract. What happens to the Brand’s content and data at the end of the Contract is governed by the Contract.

14. Personal data

The privacy policy describes the data UNQ processes, why, with whom, for how long, and how to exercise your rights.

15. Changes to the Terms

UNQ may change these Terms, in particular to reflect changes in the Sites, the Service or the law. The applicable version is the one published at the time of use; its date appears at the top of the page.

16. Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute relating to their interpretation or performance, the parties will first seek an amicable solution. Failing that, the dispute will be brought before the competent courts of Grenoble, subject to the mandatory rules that allow a consumer to bring proceedings before another court.
